Terms of Service

1. Overview

Welcome to KickOps ("we", "our", or "us"). This website and the KickOps DevOps setup (collectively, the "Services") are operated by MeteorOps, Inc. By accessing or using our Services, you agree to be bound by these Terms of Service and all applicable laws and regulations.

2. License and Usage Rights

When you purchase KickOps, you are granted a non-exclusive, non-transferable license to use the DevOps setup for your organization's internal use. This license is for a single organization.

The KickOps boilerplate, infrastructure templates, and all related materials are provided for your use within the scope of the purchased tier. You may modify these materials to suit your specific needs but may not redistribute them as standalone products.

2.1 Redistribution Prohibition

Licensee shall not, under any circumstances, redistribute, resell, sublicense, lease, lend, rent, transmit, duplicate, or otherwise make available the KickOps materials, in whole or in part, to any third party without prior written authorization from MeteorOps, Inc. This prohibition includes, but is not limited to:

• Creating derivative works based on the KickOps materials for commercial distribution;
• Incorporating KickOps materials into publicly accessible repositories;
• Including KickOps materials in any product or service offered to third parties;
• Sharing access credentials to KickOps materials; and
• Any form of distribution, whether for consideration or without charge.

2.2 Special Licensing

Notwithstanding the foregoing, MeteorOps, Inc. may, at its sole discretion, grant a separate written license specifically authorizing redistribution rights under terms and conditions to be negotiated separately from this agreement. Any such redistribution license must be explicitly documented in writing, executed by authorized representatives of both parties, and may require additional compensation to MeteorOps, Inc.

2.3 Rights Reserved

All rights not expressly granted herein are reserved by MeteorOps, Inc. This license does not convey any ownership interest in the KickOps materials. MeteorOps, Inc. retains all right, title, and interest in and to the KickOps materials, including all intellectual property rights therein, whether registered or unregistered, and wherever in the world those rights may exist.

3. Subscriptions and Payments

KickOps offers one-time payment options for different tiers of service. Payment is required upfront before access to the Services is granted. All fees are non-refundable except as specified in our Refund Policy.

We reserve the right to change our prices at any time. Any price changes will not affect previously completed purchases.

4. Support and Services

The level of support and services provided depends on the tier you purchase:

• Explorer tier includes a 60-minute consultation and practical recommendations.
• Builder tier includes full boilerplate access, setup assistance, and training.
• Perfectionist tier includes everything in Builder plus a 20-hour bank with a DevOps expert and community access.

We will make reasonable efforts to provide these services in a timely and professional manner, but specific turnaround times are not guaranteed unless explicitly stated.

5. Intellectual Property

All content included in the Services, such as text, graphics, logos, code, templates, and documentation, is the property of MeteorOps, Inc. or its content suppliers and is protected by international copyright laws.

While you are granted a license to use the KickOps setup, you do not own the intellectual property rights to the underlying templates, methodologies, or systems.

6. Limitation of Liability

MeteorOps, Inc. shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Services. This includes but is not limited to damages for loss of profits, data, or other intangible losses.

We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free. Your use of any information or materials obtained through the Services is at your own risk.

7. User Responsibilities

You are responsible for maintaining the security of your environment. While KickOps provides secure infrastructure templates, proper implementation and ongoing maintenance are your responsibility.

You agree not to use the Services for any illegal purposes or in any way that could damage, disable, or impair the Services or interfere with any other party's use of the Services.

8. Term and Termination

These Terms remain in effect while you use the Services. We reserve the right to terminate or suspend your access to the Services at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to us, the Services, or third parties.

9. Changes to Terms

We reserve the right to modify these Terms at any time. Updated terms will be effective immediately upon posting on the KickOps website. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
